DEWALT EXTREME CORDLESS CHALLENGE
RULES AND REGULATIONS

This DEWALT Extreme Cordless Challenge (the “Challenge”) is sponsored by DEWALT Industrial Tool Company (“DEWALT”) and Lowe’s Home Improvement Stores, Inc. (“Lowe’s”). The Challenge will run from March 1, 2005 through September 30, 2005 (the “Challenge Period”). The Grand Prize Winner will be selected on or about October 5, 2005.
1. NO PURCHASE NECESSARY TO ENTER OR WIN
2. HOW TO ENTER
In order to enter, each participant must completely fill out the information required on the Entry Form (the “Entry Form”) accessed at www.dewalt.com (the “Website”) or available at the Challenge Events (as defined below). The information requested marked “optional” on the Entry Form may be answered at the participants’ discretion. Participants must arrive at the Challenge Event before the end of the registration period for such Challenge Event. Participants may enter as often as they like, but once a participant is declared an Event Winner (as defined below), they are ineligible to participate in all future Challenge Events. Participants may be required to show proof of identification at registration of all Challenge Events.
3. CHALLENGE EVENTS
During the Challenge Period, approximately two hundred fifty (250) contest events (each a “Challenge Event”) will be conducted at participating Lowe’s retailers (to obtain the dates and locations of the Challenge Events please visit the Website or send a self addressed stamped envelope to DEWALT Extreme Cordless Challenge Event Schedule, 701 E. Joppa Road, Towson, Maryland 21286, mail stop #TW395 in which each participant will attempt to record the fastest Valid Time (see below for definition) for the respective Event. The participant with the fastest Valid Time at each Challenge Event shall be declared an “Event Winner” and will have an opportunity to be eligible for the Grand Prize (as defined below). In the case of a tie, each participant with the fastest Valid Times will be declared an Event Winner. The Event Winner need not be present when the Event Winner is declared.
4. GRAND PRIZE WINNER
At the end of the Challenge Period, the Event Winner with the fastest Valid Time of all Event Winners shall be declared the “Grand Prize Winner.” In the event of a tie, each Event Winner with the fastest Valid Time shall be declared a Grand Prize Winner. The Grand Prize Winner need not be present when Grand Prize Winner is declared.
5. THE COMPETITION
During each Challenge Event, each participant will be timed to determine how fast the participant can complete the Challenge which requires participates to complete the four (4) Cordless Challenge stations in the fastest Valid Time (as defined below). At each Challenge Event, DEWALT will provide a contest workstation and all contest materials. Participants must use the materials, protective gear and materials provided by DEWALT. Participants will not be allowed to bring their own cordless tool or other materials (including, but not limited to, batteries, drill bits, gloves, etc); except for medical devices for an underlying medical condition. Participants will select from the materials provided which battery they wish to use during the Challenge. The participant will insert the battery into the drill and test it. Please note that the participant should select the appropriate speed in which to use each tool, however, use of Speed 3 will burn out the motor and will not produce a faster Valid Time, therefore participants should not use Speed 3. The participant will then place the drill in the holster and notify the DEWALT representative that the participant is ready to begin. The DEWALT representative will give the go ahead. The participant is not permitted to touch the Challenge Station or the drill prior to starting the timer or any of the Challenge materials except as expressly set forth herein.
In order for a participant to record a “Valid Time,” after receiving the go ahead from DEWALT representative the participant must complete the following steps: (1) Start the timer; (2) Remove the drill from the holster; (3) Drill a hole completely through a 4x4 pressure treated lumber board so that the hole is the same diameter at the entry and exit point; (4) Change the battery into the DC520 Drywall Gun; (5) Drill three (3) 1 ¼” coarse thread drywall screws flush with drywall board; (6) Change the battery into the DW056; (7) Fasten one (1) 5/16” x 2 ½” lag screw into pressure treated wood such that the washer does not rotate or otherwise move; (8) Change battery into the DW960; (9) Drive three (3) 1 ¼” coarse thread drywall screws flush into 2” x 6” pine; (10) Put drill into holster; (11) Stop the timer. In order for items to be “flush,” the DEWALT representative should be able to pass a wood board or other straight edge over all of the screws without catching on any of the screws. The participant should put each tool into the appropriate station holster at the end of each station. No participant may be touching the cordless tool when the timer is stopped or the participant will be disqualified. Only Valid Times will count during the Challenge Period. In the event of a false start (a participant touches or removes the Drill from the holster prior to the start button being hit but after being given the ready sign to the DEWALT representative to begin the Challenge), the participant will be permitted one make up chance. Each participant will be given one opportunity to record a Valid Time and one false start.
The failure of the participant to check that (i) the battery is charged to his/her satisfaction, (ii) the proper speed selection is made on the drill, (iii) the forward/reverse switch is in the right position or (iv) ensure that the tool is locked and tight shall not be deemed a mechanical failure. Failure to check the battery strength or properly load the battery into any tool will not be deemed a mechanical failure.
6. EVENT WINNER
Each Event Winner will receive a DEWALT DC6KITA Heavy-Duty XRP™ 18V Cordless Combo Kit (with an approximate retail value of $600.00). The approximate total aggregate retail value of all Event Winner’s Prize packages is $150,000.
The Grand Prize Winner will receive a DEWALT Cordless Tool Package with an approximately retail value of $5,500.00, consisting of one of each of the following (i) DEWALT DC500 Cordless/Corded 2 gal. No substitutions or exceptions permitted to be made by the Grand Price Winner.
The maximum approximate total retail value of all prize packages under the Challenge is $155,576. All prizes are expected to be delivered by April 1, 2006, except as otherwise noted herein. All prizes are non-transferable and are not redeemable for cash. DEWALT reserves the right to substitute any prize for a prize of equal or greater value. Unclaimed prizes will not be awarded.
7. ELIGIBILITY
The Challenge is open to legal residents of the USA residing in the 48 contiguous states, the District of Columbia, Alaska or Hawaii, 18 years of age or older. Participants will be allowed one entry and attempt per day. Current employees or individuals who have been employed at any time since January 1, 2005 by DEWALT, participating retailers, their affiliates, manufacturers, sales reps, subsidiaries or parent companies, advertising/sales promotion agencies, judging organizations, and the immediate families of each are not eligible. The team members of the 2004 DEWALT PIT CREW CHALLENGE FINALISTS, and Regional Finalists of the 2003 MILLION DOLLAR CHALLENGE and the 2002 MILLION DOLLAR CHALLENGE are also not eligible. Void where prohibited. Entry materials become the property of DEWALT. DEWALT is not responsible for lost, late, damaged, misdirected, or illegible entry forms. Participants under the influence of alcohol or drugs will not be allowed to participate in the Challenge. Individuals who appear to be intoxicated or under the influence of any drugs or alcohol may be disqualified in DEWALT’s sole discretion.
8. CONDITIONS
Void where prohibited. All federal, state, and local laws and regulations apply. DEWALT is not responsible for any expenses (except as set forth above) incurred by participants in connection with participation in the Challenge or the claiming or use of any prizes. All participants who participate in the Challenge must conduct themselves in a safe and prudent manner for their safety and the safety of those around them. If DEWALT believes any participant is operating in any unsafe manner, they will be immediately disqualified in DEWALT’s sole and absolute discretion. In the event of bad weather or any other event beyond the control of DEWALT which, in DEWALT’s sole discretion, makes it unsafe, impossible, or unfair for other participants to continue, DEWALT may discontinue and stop the Event, and may, but is not obligated to, continue the competition at another time or day. In the event of such rescheduling or postponement, both days shall be deemed one Event. By submitting an Entry Form, each participant agrees to be bound by these Challenge rules, and any decisions related to the Challenge, the Challenge rules, and the operation of the Challenge, the qualifications, and eligibility of any participant, and any decisions related to these Challenge Rules are at the sole discretion of DEWALT and are final. Each participant agrees to release and hold DEWALT and Lowe’s, their employees, officers, directors, shareholders, agents, representatives and their subsidiaries, parent companies or other affiliated companies harmless from any and all damages, losses, claims and/or liabilities, direct or indirect, arising out of his or her participation in the Challenge or resulting from accepting or claiming or using any prize awarded hereunder. DEWALT reserves the right, in its sole discretion, to alter, change, terminate, suspend or otherwise cancel the Challenge at any time for any reason. These Challenge rules are subject to change without notification. Participants may be required to complete a Liability Release Form. Participation in the Challenge constitutes permission (except where prohibited by law) to use winners’ names, likenesses, biographical information, photographs, video and any statements or remarks made about winning or participating in the Challenge for advertising and promotional purposes (in any medium) without additional compensation. Participants acknowledge and agree that DEWALT may share any and all information collected through the Challenge from time to time with its subsidiaries, affiliates, third parties providing services on its behalf, sponsors of certain promotions or partner companies. DEWALT may verify that all winners are qualified. If any participant commits any act or is involved in any situation or occurrence which informed parties can reasonably conclude brings DEWALT into public disrespect, scandal or ridicule, shocks or offends the community, detracts from the public image of DEWALT, or reflects unfavorably upon DEWALT, DEWALT shall have the right, at its sole discretion, to disqualify the participant from the Challenge.
In the event of a mechanical failure of the timer or the rig, or a mechanical failure of the cordless tool, which failure is beyond the control of the participant (including, but not limited to, motor burns out, drill fails to operate, etc.), the participant will be allowed to retake the Challenge.p>
