NATIONAL SWEEPSTAKES
RULES AND REGULATIONS
This 2006 Winner's Circle National Sweepstakes (the "Sweepstakes") is sponsored by Black & Decker (U.S.) Inc. d/b/a DEWALT Industrial Tool Co. ("DEWALT") and Home Depot U.S.A., Inc. ("Home Depot"). The Sweepstakes begins on July 1, 2006 and ends on September 30, 2006 (the "Sweepstakes Period").
- NO PURCHASE NECESSARY TO ENTER OR WIN.
- HOW TO ENTER.
In order to enter, each participant must completely fill out the information required on the Entry Form (the "Entry Form") accessed at www.dewalt.com/winnerscircle or www.homedepot.com/winnerscircle (the "Websites") or available at participating The Home Depot® retail locations. The information requested marked "optional" on the Entry Form may be answered at the participant's discretion. Limit one (1) entry per participant per day. All Entry Forms submitted via the websites must be received by DEWALT no later than 11:59 p.m. EST on September 30, 2006, or if sent by mail postmarked by September 30, 2006.
DEWALT reserves the right to verify that each Winner is qualified and entitled to receive a prize. Each Winner will be required to complete an Affidavit of Eligibility and Liability/Publicity Release or his prize will be forfeited. Acceptance of a prize constitutes permission (except where prohibited by law) to use Winner's name, likeness, biographical information, photographs and any statements or remarks made about winning the prize or participating in the Sweepstakes for advertising and promotional purpose without additional compensation.
- DRAWING.
Forty (40) random prize drawings will be held at DEWALT headquarters in Towson, Maryland on or about November 1, 2006. A DEWALT representative will be present to conduct the drawings. The first entry drawn will be declared the Grand Prize Winner. The next four entries drawn will be declared First Prize Winners. The next ten entries drawn will be declared Second Prize Winners. The next twenty-five entries drawn will be declared Third Prize Winners. Participants need not be present to win. Winners will be notified either by phone or by mail within seven (7) days of the drawing. All qualified entries will be placed in the drawing. Odds of winning a prize depend on the number of eligible entries received. Failure to accept a prize within 30 days of the drawing shall constitute forfeiture and no prize shall be awarded.
- PRIZE.
One Grand Prize Winner will receive two (2) 2006 Chevrolet Silverado 1500 Extended Cab Trucks (approximate retail value $35,000 each). The total approximate retail value for the Grand Prize is $70,000.
Four First Prize Winners will each receive his or her choice of one of the following: (A) a trip for two to the 2007 Miami NASCAR Race at the Homestead-Miami Speedway in Miami, Florida consisting of two (2) round-trip coach air transfers from the major commercial airport nearest the First Prize Winner's residence, two (2) race passes to the 2007 Miami NASCAR Race at the Homestead-Miami Speedway, two (2) hospitality and pit tours at the Homestead-Miami Speedway and two (2) travel vouchers for $1,500 each for use towards ground transportation, hotel accommodations and other travel expenses (approximate retail value $5,000) OR (B) a DEWALT tool package (approximate retail value $5,000). The total approximate retail value for all Second Place Prize Packages is $20,000. DEWALT or its designee shall arrange the air transportation arrangements for each First Prize Winner that selects prize package (A). (See "Conditions" below for additional details).
Ten Second Prize Winners will each receive his or her choice of one of the following: (A) DEWALT DC9PAKIA Heavy-Duty 18V Cordless 9-Tool Combo Kit (approximate retail value of $1,000) OR (B) one (1) voucher for the Richard Petty Driving Experience (approximate retail value of $799). The total approximate retail value of all Second Prize Winners is between $7,990 and $9,990.
Twenty-five Third Prize Winners will each receive his or her choice of one of the following: (A) a $300 The Home Depot Gift Card OR (B) a DEWALT DC920KA Heavy Duty XRP ˝" 18V Cordless Drill/Driver Kit (approximate retail value of $269). The total approximate retail value of all Third Prize Winners is between $6,725 and $7,500.
The total maximum approximate retail value of the prizes for all winners is $107,490. Winners should allow 4 to 6 weeks from notification for delivery of the prizes, except as otherwise noted herein. Any Grand Prize Winner who elects at his or her sole discretion to customize either of the vehicles received should expect a delay in the delivery of these prizes. Delivery of the Grand Prize will occur at such times as the authorized Chevrolet dealer can deliver such customization. Delivery of the Grand Prize will take place at the local dealer closest to the Grand Prize Winner's residence. The First Prize shall be delivered to the First Prize Winners within 4 to 6 weeks of the 2007 Miami NASCAR Race. Second Prize and Third Prize winners have their option of either prize package in that category, and to the extent that they select the prize package with the lower retail value, they are not entitled to receive the difference in cash or any other consideration. DEWALT and Home Depot reserve the right to substitute any prize for a prize of equal or greater value. All prizes are non-transferable and are not redeemable for cash. DEWALT reserves the right to substitute any prize for a prize of equal or greater value. The failure to accept any prize within 30 days after the drawing shall result in a forfeiture of all prizes awarded hereunder.
- Eligibility.
The Sweepstakes is open to legal residents of the U.S. residing in the 48 contiguous states, Alaska, Hawaii and the District of Columbia, who are 18 years or older at the time of entry. Individuals who are or were employees of DEWALT, Home Depot, their affiliates, manufacturers, sales representatives, subsidiaries or parent companies, advertising/sales promotion agencies, judging organization since January 1, 2006 and the immediate families of each are not eligible. Void where prohibited. Entry materials become the property of DEWALT and Home Depot and will not be acknowledged or returned. DEWALT and Home Depot are not responsible for lost, late, damaged, misdirected or illegible Entry Forms, computer or software failures, or unsuccessful attempts to notify the winners. Any attempt by a participant to use multiple e-mail accounts or multiple e-mail addresses to multiply the number of daily entries or any attempt to use an automated system or agent to submit entries is prohibited and will result in disqualification from the Sweepstakes. Limit of one (1) prize per household or family. In the event of a dispute as to registration, the authorized account holder of the email address used to register will be deemed to be the participant/registrant. The authorized account holder is the natural person assigned to the email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. A participant or potential winner may be required to show proof of being the authorized account holder of the email address.
- Conditions.
All federal, state, and local laws and regulations apply. Void where prohibited. Neither DEWALT nor Home Depot is responsible for any expenses incurred by participants in connection with participation and the claim or use of any prizes awarded in the Sweepstakes. By submitting an Entry Form, each participant agrees to be bound by these Sweepstakes rules, and any decisions related to the Sweepstakes, the Sweepstakes rules, the operation of the Sweepstakes, and the qualifications and eligibility of any participant are at the sole discretion of DEWALT and are final. Each participant agrees to release and hold DEWALT, Home Depot, their employees, officers, directors, shareholders, agents, representatives and their subsidiaries, parent companies or other affiliated companies harmless from any and all damages, losses, claims and/or liabilities arising out of his participation in the Sweepstakes or resulting from accepting or claiming any prize awarded hereunder. DEWALT and Home Depot reserve the right, in their sole discretion, to terminate, suspend or otherwise cancel the Sweepstakes at any time for any reason. Participants may be required to complete a Liability Release Form. Participation in the Sweepstakes constitutes permission (except where prohibited by law) to use winner's name, likeness, biographical information, photographs and any statements or remarks made about winning or participating in the Sweepstakes for advertising and promotional purposes (in any medium) without additional compensation. Participants acknowledge and agree that DEWALT and Home Depot may share any and all information collected through the Contest from time to time with their subsidiaries, parent companies, or other affiliated companies in accordance with the privacy policies posted on www.dewalt.com and www.homedepot.com, respectively. DEWALT and Home Depot may verify that all winners are qualified. Income and other taxes (if any) are the responsibility of the winner. Title and registration fees are the responsibility of the winners. All travel is subject to availability for chosen time of travel. Travel does not include upgrades in airfare, travel arrangements to and from the airports, additional hotel nights, additional hotel guests, meals, room service or any other incidental costs. Travel does not include hotel and airport taxes.
